  • Arkansas: The state has replaced the older hemp bill, thanks to which smoking delta 8 is now legal in Arkansas.
  • Florida: For the time being, delta 8 is legal in Florida. However, it could change as a new bill is waiting to be passed. 
  • Hawaii: Smoking delta 8 is legal here. However, you can’t use delta 8 edibles or inhalable products. 
  • Massachusetts: If you live in Massachusetts, you can freely smoke delta 8 or any other recreational marijuana product. 
  • Missouri: All hemp-derived products are legal in Missouri, including delta 8 flowers.

Apart from these states, smoking Delta 8 is also legal in Georgia, Illinois, Indiana, Kansas, Kentucky, Maine, Maryland, Minnesota, Nebraska, New Hampshire, and North Carolina, among others. Similarly, it is regulated as recreational cannabis in states such as Connecticut and Michigan. Currently, smoking delta 8 is illegal in 13 states, namely, Alaska, Washington, Colorado, Rhode Island, Delaware, North Dakota, Nevada, New York, Montana, Iowa, and Idaho. Apart from these states, the law regarding delta 8 is unclear in Arizona, Mississippi, and California. 

Lastly, delta 8 THC is lawful in the United States, but it doesn’t mean that anyone can drive under its influence. While existing drug tests can detect the use of THC, traces of THC remain in the human body for more extended periods. Moreover, scientists are not sure how to measure the level of THC in the blood that can cause impairment.

THC doesn’t have any measurement, unlike alcohol, where there is a clear limit of 0.08 blood alcohol concentration (BAC). Still, THC affects the ability to drive and maintain focus in addition to slow reflexes. Due to this, it’s not wise to smoke delta 8 flower before driving. So that roads will be safer for everyone if no one drives under the influence of any psychoactive substance.
